State Advocate Drushantha Ramsamy testified before the Madlanga Commission on 11 August 2026 that Police Minister Senzo Mchunu allegedly bypassed established protocols by routing a sensitive Inspector-General of Intelligence (IGI) report to the Investigating Directorate Against Corruption (IDAC), after the IGI had refused to share it while their investigation was ongoing.

Allegations Of Protocol Breaches In Intelligence Report Handling

According to Ramsamy’s statement, IDAC’s suspended chief investigator Dylan Perumal informed investigators in September 2026 that Mchunu arranged for an individual to fly to him in the Eastern Cape and deliver the restricted IGI report directly. “In September, Perumal told us that Mchunu arranged with someone to fly to him in the Eastern Cape and provide the IGI report,” Ramsamy told the commission.

The IGI had refused to give the report to IDAC due to procedural constraints, as sharing would have interfered with ongoing IGI investigations. Ramsamy said, “There are certain procedures and processes that have to be followed before the sharing of that information.” The report reportedly details an investigation into Crime Intelligence and was described by Perumal as ‘golden’ evidence in the IDAC’s case against Crime Intelligence head Lieutenant-General Dumisani Khumalo and his senior colleagues.

Significance For Crime Intelligence Case And Systemic Oversight

Ramsamy also revealed that during her sick leave, a separate case against Khumalo was enrolled in court before she had completed an assessment. She testified, “In June, I had read the docket, and I found that there were no merits for enrolment.” This suggests possible procedural irregularities beyond the handling of the IGI report itself.

The Madlanga Commission is investigating misconduct and procedural failings within South Africa’s law enforcement agencies. The case raises new concerns about whether checks and balances are functioning to ensure integrity and transparency when sensitive intelligence evidence is handled by top officials.
